Had a crash yesterday...who's liable?! (photos on page 2)

    I've just been down to the site of the accident....there are actually three lanes approching the roundabout the left lane is LEFT ONLY. The second is STRAIGHT ON ONLY (this is the lane that the focus was in) and lane 3 That I was in was straight on and right (there were actually only 2 lanes going around the roundabout as the first lane approaching the roundabout was strictly for left turn and filtered out quite a bit before the main part of the roundabout.

    How do the lane markings (arrows) stand when it comes to the law of the road?

    So he turned right from the left hand lane then?

    He shouldn't have done that but you shouldn't overtake on a roundabout. if you were level with him when you entered the roundabout, it's his fault. If he entered the roundabout before you, it was yours.

    Did you get the details of the Audi? Did they stop too?

    So what you are saying is that he turned right from an ahead only lane? His fault then...

    Yep, the lane markings only increase the strength of your case.

    If you follow the van and the honda thing....I in the leon being the van and the honda being the focus instead of the honda going in the left lane on the duel carrigeway he went in front of me and to the right....

    Think you should have that sorted by now tho eh!

    so basiclly theres to lanes off he thought there was only one and merged into yours with you next to him

    Yep Vento I'm even more convinced that he was in the wrong.

    In my area I have a few roundabouts with the same type of markings, thus basically if your a competent driver you follow the markings and you shouldn't go wrong, until you get some dithering old idiotic git who can't read or observe any road markings and just carries on regardless, causing absolute mayhem to everbody else on the road, because thats the way he has always driven.

    In one word ARSES, who should be banned from the road.

    Vento please do not under any circumstances give up on this. These type of drivers, now I'm just classing old foggies on this but generally any driver who can't read a simple road sign or layout, should be banned from the road, and incidents like this just wouldn't happen.

    from your pictures that looks 100% clear that he was in the wrong.

    Thanks chaps...I think im gonna try and go all the way with this....was sure i'd not done much wrong to start with but went off the boil a bit and was partially blaming myself! But the more people I talk to.....!

    The second to last photo shows it best how the focus driver was in the wrong. The photos would be worth sending to your insurers and pointing out the lane markings and your direction, should get better than a 50/50 payout, id go for a minimum 80/20 in your favour as it can always be said you should have checked your near side blind spot just in case some one was there, as there was.
