Very very very unhappy - Insurance payout offer - advice please

    couple of Fridays ago a BMW plughed into the back of me at 50 mph plus on the M11 whilst i was stopping for traffic build up. Pushed me into the central barrier, span me round and wrecked my almost mint, 80,000 mile MK2 GTI.
    I bought it 3 years ago with 18,000 on the clock from the 1 and only owner, an elderly lady. I am really very unhappy and distraught as i probably wont find another like it and the 'person' driving the BMW was not insured and i am not fully comp, so now i am probably 3000 out of pocket.

    The engine is nearly new with only 80K and the inside is perfect, apart from the boot now being in the rear seat. Is there any value in the perfect bits that aren't bent or should i just let a scrappy have it all?

    Any comments would be helpful. Anyway, i walked out of it completely unscathed, thank you dead Golf.

    Definitly take all the good bits out and sell them trough classifieds here and on ebay - if you have history to back up the engine, then thats of some good value, the interiors sell for upto 120 in excellent condition....there's loads of scope to claw some cash back before it goes to the scrapper! Besides, most would likely charge you to collect it!

    Defo break it for spares, there's money to be made. As an example I sold the engine, box, and most of the ancillaries out of my MK2 GTI for 175, and that had 110k on it, so you should draw more for your 80k engine and box.

    On another note, I am sure there is some way you can still claim for the damage done to your car, i am sure there is a fund to cover accidents caused by uninsured drivers? Might be worth seeking legal advice.

    If your name was Earl, I would say this was 'Karma' ! I mean, getting something so good (18K, one owner....) and something bad was bound to happen!

    Jesus, I know how you feel 'cos mine was lost due to there being no witness to say what happened. It went 50/50, I was gutted, but it wasn't as mint as your's sounds.

    Perhaps the best would be to buy an average car and swap all the bits you can (seats must be near perfect with no wear, steering wheel not worn, etc...) You would have loads of spares (providing you have storage). I considered this, but needed a car quick so bought a Saab.... wish I had done the above a few times during that 15 month period!

    Thanks for the input, all very useful and back up what i thought about there being money in it. I do have pictures but can't get my head round this 'insert image' and URL business...

    I have been down this road, 2 yrs back an uninsured guy in a Punto stoved the back of my Astra SRI fxx it completely just of the blackwall tunnel. There is a fund paid into by insurance comapanies to cover claimants like yrs. Its an **** as its cost around 250 to even apply for funding which as a third party only policy holder you will be liable for. If you apply your are not guaranteed a payout, injury claims tend to be dealt with the most successfuly. Its one of those things sounds like a pretty valueable motor car so may be worth while. Did you get the drivers details if so pay him a visit and kindly request yr money with smiles and please's

    get a new body shell and transfer every thing good over to the new shell, seen a few project shells knocking around on vw sites and e bay.

    The MIB can pay out for uninsured drivers, don't know if they put any conditions on when they pay out though (they might only do it if they think they've got a reasonable chance of tracking down the uninsured driver). I had a crash a few years back and it turned out I wasn't insured (long story, but Firebond are a bunch of fecking useless ar*e-fairies [:x] [:x] ). MIB paid out on my behalf (and without my knowledge) and then about 18 months later sent my debt to a collection agency for them to hassle me for. That was possibly the most expensive escort rear bumper in christendom [:^(]

    Sh*t, that's harsh Martyn. Without asking you to go into details, what did the insurance company do (or not do) to mean you weren't insured?

    Apparently they never recieved my proof of no-claims when I first set up the policy, must have got lost in the post. So, they sent me a letter recorded delivery saying they were cancelling the policy because of this. I never got that letter (wasn't in to sign for it and never found a card) so it got sent back to their office. Despite knowing that I wasn't aware of the policy being cancelled, they didn't bother to make any further effort to contact me and actually tell me. First I knew of it was a few months later when I phoned up to tell them about the incident "Oh no sorry sir, your policy was cancelled in August" [:x] [:x] [:x]

    So, one court appearance later and i'm 150 lighter and with 6 shiny new points on my license, then about a year after that a nice bill for 3500 for what looked at the time to be just a 'Srote back bumper. Oh, and of course being anally raped by insurance companies for the next five years for being so incomprehensibly evil as to having had a policy cancelled on me, and the points for trying to drive without paying them their hard earned and well deserved cash (I have a mate who had a DD ban and his insurance cost less than mine on a similar car at the time).

    No, not really. Didn't have the sense at the time to get any kind of proof from them (like they'd stump it up anyway). I did have a chat with a solicitor when I got my court summons, and he said basically not worth it, just explain to the magistrates the circumstances, play the poor student and hope they feel nice. I did actually get away with the very bare minimum they could give me.

    Probably would have been worth fighting if I'd known at the time how much it was going to cost me over the next 5 years or so in terms of the bill for the damage and then the silly insurance premiums [:^(]

    Theres something not right about a legal system that requires you have motor insurance, yet if somebody without goes into you they somehow get away with it!

    I hope they gave you the correct details and you got some whitness's! Take em for all they got I say. b*stards!

    Channel your energies into getting onto the next car sorted, but leave a residual amount for sorting this uninsured scum out through the courts.

    Expect to lose (they always get away somehow), but give them enough heart jumps to make their lives a proper misery for the next year with court appearances etc etc.
